When a 1031 exchange is not the answer

A 1031 exchange defers your gain as long as you buy more real estate. That works well while you are growing a portfolio.

It is less helpful when the whole point is to own fewer buildings. Maybe you want investments with no tenants and no maintenance. Maybe you want to diversify into stocks, bonds, notes, or private investments. Maybe you still like real estate and you are ready to let someone else do the operating.

Long-time owners often end up weighing two choices: keep a property they are ready to be done with, or sell it and send a large share of the gain to taxes. This class is about a third choice.

What is a Deferred Income Trust?

In plain English, a Deferred Income Trust pairs an irrevocable trust with an installment sale. As Todd teaches it:

  • The owner sells the property to a trust and receives a promissory note in return.
  • An independent trustee handles the sale proceeds.
  • The seller is paid over time under the note.
  • The proceeds can be placed in investments other than real estate.

Because the seller is paid over time, the strategy is intended to defer eligible gains instead of having them all come due in the year of the sale.

It is a sophisticated transaction. Irrevocable means you give up ownership and control. Deferring a gain is not the same as making every tax disappear. Those tradeoffs are a large part of what Todd covers.
